1. Acceptance of Terms

By accessing or using any matchmaking, coaching, consulting, event, or membership service offered by Matchmaker Amy (“Company,” “we,” “our,” “us”), you (“Client,” “User,” “you”) agree to be bound by these Terms and Conditions (“Terms”), along with our Privacy Policy and any addendums, service agreements, and membership rules applicable to your specific program.
If you do not agree, you must not use or access the Services.

2. Eligibility

To use the Services, you represent and warrant that:

You are at least 18 years of age (or the age of majority in your jurisdiction).
You are single, legally separated, or otherwise legally free to date.
All information you provide to us is truthful, complete, and accurate.
You will promptly update us if any material personal circumstances change, including relationship status, residence, health conditions relevant to dating, or contact information.

The Company reserves the right to refuse service to anyone for any reason permitted by law.

3. Nature of Services

The Company provides matchmaking, dating coaching, consulting, events, classes, and other related services (“Services”). Specific program details, deliverables, and timelines may vary.

You acknowledge and agree that:

Matchmaking is inherently subjective.
No specific result is guaranteed, including matches, dates, relationships, or marriage.
Match recommendations are based on the Company’s professional judgment, not on objective standards of compatibility.
You are solely responsible for your interactions with matches and other participants.

The Company reserves the right to modify, pause, or discontinue any aspect of the Services at any time.

4. Client Responsibilities

You agree to:

Provide truthful and non-misleading information throughout your engagement.
Participate actively in the process, including attending meetings, responding to communication, and providing feedback in a timely manner.
Conduct yourself respectfully with staff, matches, and other clients.
Use Services for personal, non-commercial purposes only.
Follow all safety precautions when meeting matches offline.
Maintain confidentiality regarding any information about other clients or matches.

Prohibited behavior includes, but is not limited to:

Harassment, discrimination, or inappropriate conduct.
Using Services to solicit, promote, or recruit for any business, social, or religious activity.
Recording calls or meetings without explicit written consent.
Providing false identity, photos, or background information.
Sharing confidential details of matches with third parties.

Violation of these obligations may result in immediate termination without refund.

5. Payment Terms

All Services must be paid in full before commencement unless otherwise stated in writing.
All fees are non-refundable, except where expressly permitted in a separate written agreement.
Payment plans (if offered) must be completed according to schedule; late or failed payments may suspend access to Services.
Prices and fees are subject to change without notice for future purchases.

6. No Guarantees

You understand and agree that:

The Company does not guarantee introductions, dates, matches, relationship success, or any specific outcome.
The Company does not guarantee the number, frequency, or timing of matches.
The Company does not vet or perform background checks on all matches, unless explicitly agreed to in writing.

7. Confidentiality and Privacy

The Company processes personal information according to its Privacy Policy.
However, you acknowledge that:

Information you voluntarily provide to matches is at your own risk.
The Company cannot control what matches do with information you share.
The Company may share certain non-sensitive profile details with potential matches for matchmaking purposes.

The Company may use anonymized or de-identified data for marketing, analytics, or promotional materials.

8. Intellectual Property

All content provided by the Company—including website content, branding, photos, course materials, videos, frameworks, methodologies, and written content—is owned by the Company or its licensors.

You may not copy, reproduce, distribute, modify, publicly display, or create derivative works without prior written consent.

Any testimonials, feedback, or content you submit to the Company may be used for marketing or operational purposes, with your first name or initials unless you request anonymity in writing.

9. Safety Disclaimer

The Company does not screen every user or match.
You are solely responsible for evaluating the safety and suitability of meeting or communicating with any individual.

The Company is not liable for:

Harm, misconduct, actions, or omissions of any match, client, or third party
Events or interactions occurring outside Company supervision
Decisions you make based on advice, coaching, or recommendations

Use common-sense precautions when meeting people offline.

10. Limitation of Liability

To the fullest extent permitted by law, the Company, its owners, employees, contractors, and affiliates shall not be liable for any:

Indirect, incidental, special, exemplary, or consequential damages
Loss of data, opportunity, revenue, or emotional distress
Actions or conduct of third parties, including matches
Dating outcomes or relationship outcomes

In all cases, the Company’s total liability shall not exceed the amount you paid for the Services.

11. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates from any claims, losses, damages, legal fees, or liabilities arising from:

Your use of the Services
Your interactions with matches
Your breach of these Terms
Any content or information you provide

12. Termination

The Company may suspend or terminate Services immediately if you:

Violate these Terms
Behave abusively toward staff or matches
Provide false or misleading information
Engage in conduct the Company deems unsafe or inappropriate

Termination does not entitle you to a refund unless explicitly stated in a separate written agreement.

You may end your participation at any time, but fees already paid will not be refunded.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions.

Any dispute shall be resolved exclusively in a state or federal court located in San Francisco County, California.

Both parties waive any right to a jury trial.

14. Modifications

The Company may update these Terms at any time.
Revised Terms become effective upon posting on the website.
Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
